Fine Collection Employees Referred to Criminal Court for Misappropriating Funds of a Public Institution

Public Funds Prosecution in Dubai Public Prosecution referred two accused persons of Arab nationality, working in one of the banks, to the Criminal Court, as they committed the felony offence of abusing their office and misappropriating the funds of the institution wherein they were working; one of the national bank in the country.

Counselor/ Salem Ahmed bin Khadem, senior chief prosecutor at Public Funds Prosecution in Dubai Prosecution said that the first accused, working as a collector in one of the bank, as his nature of job was to receive the cash fines being collected from the departing passengers for the government entity, abused his office and misappropriated an amount of AED. 41,164 belonging to that public entity and left the country, thus, causing damages to the company wherein he was working by the above amount of money, which he was supposed to give to it.

The second accused was working as a collector in the payments section of the same bank in Dubai International Airport branch. His nature of job was to receive the cash fines collected from the departing passengers for the government entity. He abused his office and misappropriated for himself the money belonging to the public institution amounting to AED. 28,220, fine collections, which he was also supposed to give to it.

Counselor/ Salem bin Khadem added that they, by virtue of their conduct, also harmed the government entity wherein they were working as they were entrusted to preserve its money and interests.

Public Prosecution referred the two accused to the criminal court as they committed a felony offence, being them public servant, they misappropriated the money belonging to the public institution, harming intentionally the property and interests of the entity wherein they were working, punishable as per the Federal Penal Law and its amendments.

He pointed out that Public Prosecution asked the court to increase the punishment so as they be a lesson for others who are tempted to abuse their public office and misappropriate pubic funds in their possession. In addition, Public Prosecution is keen to apply the amendments of the law to increase the punishment in offences committed by the public servants or those entrusted with a public service, being it one of the deterrent means for such crimes.
