The Lawyers Disciplinary Council of the Judicial Department – Abu\nDhabi decided to cancel a lawyer\u2019s license and remove his name from the Roster\nof Lawyers, for committing acts that impinge on the ethics, traditions and duties\nof the legal profession towards society. In addition to the complaints punished\nby the Lawyers Disciplinary Council, final criminal rulings were issued against\nthe lawyer for assaulting, insulting and threatening an employee during his\nduty. Such behavior violates the good reputation condition stipulated by the\nlegal profession.<\/p>\n\n\n\n
In the reasoning of its decision, the Lawyers Disciplinary Council\nstated that having considered the subject matter complaint referred by the\nLawyers Affairs Committee, the respondent\u2019s reply and the relevant documents,\nit is evident that the violations included in the complaint are based on convicting\nthe lawyer under penal rulings and disciplinary decisions. This constitutes a\nflagrant violation of lawyer\u2019s code of conduct and professional ethics, and a\ndirect prejudice to its reputation, especially that for practicing the legal\nprofession, a lawyer must be of a good reputation, as this is a starting and ongoing\ncondition for registration in the Roster of Lawyers. <\/p>\n\n\n\n
The Lawyers Disciplinary Council stated that Articles No. (4 &\n5) of Federal Decree-Law No. (34) of 2022, concerning \u201cRegulation of Advocacy\nand Legal Consultancy Profession\u201d affirm that the legal profession is a free\nprofession that participates with the judiciary to achieve the mission of\njustice and affirm the rule of law. Accordingly, lawyers must abide by the rules\nstipulated by the law. In general, a lawyer\u2019s professional and personal\nbehavior must follow all the ethics, morals and traditions of the profession;\nsuch as independence, integrity and good reputation.<\/p>\n\n\n\n
The Council\u2019s decision also indicated that the law regulating the\nlegal profession stipulates that: \u201cA registered practicing lawyer must be of\nfull capacity and good reputation, and has neither been convicted by the court\nnor has been disciplinarily punished for a felony\/misdemeanor involving breach\nof honor or trust, even if his criminal record is expunged\u201d. Based on this and since\nthe violations committed by this lawyer are affirmed by criminal rulings, so\nthe Lawyers Disciplinary Council decided to cancel his license and remove his\nname from the Roster of Lawyers.<\/p>\n","protected":false},"excerpt":{"rendered":"
