The Abu Dhabi Judicial Department appreciates\nthe international trust in Abu Dhabi Courts operating under a pioneering\njudicial and legislative system, especially with the issuance of a historic judgment\nby a High Court in England, affirming that the Abu Dhabi Civil Family Court is\nthe correct forum for hearing a family dispute between a British couple\nresident and domiciled in the Emirate.<\/p>\n\n\n\n
The British High Court issued its judgment,\nconfirming that the Family Civil Court in the Emirate of Abu Dhabi is competent\nto hear the family disputes between the British couple residing in the Emirate,\nin case of disputing on the jurisdiction between the English courts and Abu\nDhabi courts.<\/p>\n\n\n\n
In his judgment, Justice Edward Hess affirmed\nthat the Abu Dhabi Civil Family Court has been established with a view to\ngiving assurance and maintaining rights of expats based on the law provisions and\nthe universally-recognized principles of justice. Therefore, the British Court is\ncontent to decide that the Abu Dhabi court, not the English Court, is the\nappropriate jurisdiction to hear the divorce case.<\/p>\n\n\n\n
This judgment has been rendered following the\njurisdiction issue raised before the British Court in relation to the divorce\nproceedings issued by the wife, as the husband argued that the Abu Dhabi court was\nthe best jurisdiction to deal with the divorce, given the fact that the couple\nis domiciled in the UAE.<\/p>\n\n\n\n
The High Court in England issued its ruling\nupholding the jurisdiction of the Abu Dhabi Civil Family Court to hear the divorce\ncase, and stressing that the embryonic court has been set up with a view to\ngiving assurance to non-Muslims and expats living in the UAE that they will be\ndealt with in a way which is commensurate with norms of non-Muslim countries. <\/p>\n\n\n\n
It is worth noting that the Abu Dhabi Civil\nFamily Court was established under Law No. 14 of 2021 regarding civil marriage\nand divorce in the Emirate of Abu Dhabi, which provides, for the first time in\nthe Middle East, a family law based on international best practices; and\nupholds the freedom of individuals and their right to marriage and divorce, noting\nthat the law allows unilateral divorce, gives equal access to divorce for\nhusband and wife, and equally treats male and female in terms of and civil\ninheritances and testimony before the court.<\/p>\n","protected":false},"excerpt":{"rendered":"
